Motoring Offences 

Motoring matters will generally not qualify for Legal Aid funding.

Our firm are happy to take instruction for these matters on a privately funded bases. We bill on a fix fee basis, please see below for more details. 

Initial Consultation with solicitor

All motoring matters must start with a consultation with a solicitor before we can accept instruction for representation in court. 

During this initial consultation the solicitor will do the following: 

  • open your client file 

  • take initial instruction

  • provide initial advice 

  • advise as to options for representation in the future 

  • provide you with a fixed fee quote for on going representation. 

 

The following is not included:

  • Representation in court 

  • Drafting of any letters, or documents 

  • Instructing of any expert witnesses

  • Taking any statements.

 

Fixed Fee £300 (excluding VAT)

This fee will then be deducted from the fixed fee if you choose to instruct us for representation. 

One hour will be allocated for this meeting, if the full time if not used, there will be no money refunded. 
For no show or cancelation will be charged in full if we are not alerted three days prior to appointment. 

Drink Driving Offence (guilty plea)

Fee includes: 

  • 2 hours attendance/preparation: 

    • considering evidence

    • Taking your instructions 

    • providing advice on the likely sentence

  • Attendance and representation at a single hearing at the Plymouth Magistrates’ Court 

 

The fee does not include:

  • instruction of any expert witnesses

  • Taking statements from any witnesses 

  • advice and assistance in relation to a special reasons hearing 

  • advice or assistance in relation to any appeal

The key stages of your matter are based on the presumption that you have entered a guilty plea and have a date for your hearing.

  • Meet with your solicitor to provide instructions on what happened

  • We will consider initial disclosure, and any other evidence and provide advice 

  • Arranging to take any witness statements if necessary (this will have an additional cost of £200 + VAT per statement) 

  • We will explain the court procedure to you so you know what to expect on the day of your hearing, and the sentencing options available to the court

  • We will conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow-up queries you have

  • We cannot provide a timescale for when your hearing will take place, as this depends on the court listing for that day

  • We will attend court on the day and meet with you before going before the court. We anticipate being at court for half a day.

  • We will discuss the outcome with you. If advice is required on appeal, this will carry an additional cost

In the event that you would wish to instruct us for a trial or special reasons hearing we will give you a quote tailored to your case.

Fixed Fee £650 (excluding VAT)

Speeding (Guilty Plea)

Fee includes:

Exceptional Hardship (Guilty Plea)

Fee includes: 

  • 2 hours attendance/preparation: 

    • considering evidence

    • Taking your instructions 

    • providing advice on the likely sentence

  • Attendance and representation at a single hearing at the Plymouth Magistrates’ Court 

 

The fee does not include:

  • instruction of any expert witnesses

  • Taking statements from any witnesses 

  • advice and assistance in relation to a special reasons hearing 

  • advice or assistance in relation to any appeal

  • If there is an initial hearing that we attend to have the matter listed for the exceptional hardship argument, there will be an additional fee of £150 plus VAT

Fixed fee £1,000 - £2,000 (excluding VAT)

Drink Driving Offence (Not Guilty Plea) - First Hearing and Half-Day Trial

Fee includes: 

  • 2 hours attendance/preparation: 

    • considering evidence

    • Taking your instructions 

    • providing advice on the likely sentence

  • Attendance and representation at a single hearing at the Plymouth Magistrates’ Court 

The fee does not include:

  • instruction of any expert witnesses

  • Taking statements from any witnesses 

  • advice and assistance in relation to a special reasons hearing 

  • advice or assistance in relation to any appeal

  • Meet with your solicitor to provide instructions on what happened

  • We will consider initial disclosure, and any other evidence and provide advice

  • Arranging to take any witness statements if necessary (this will have an additional cost of £200 +VAT per statement)

  • We will explain the court procedure to you so you know what to expect on the day of your hearing, and the sentencing options available to the court

  • We will conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow-up queries you have

  • We cannot provide a timescale for when your hearing will take place, as this depends on the court listing for that day

  • We will attend court on the day and meet with you before going before the court. We anticipate being at court for half a day.

  • We will discuss the outcome with you. If advice is required on appeal, this will carry an additional cost

  • The fee for an expert’s report will often depend on the nature of the report required. Reports can range between £150.00- £1,500 Plus VAT, and you will be given an estimate of this for you to agree to prior to any disbursements being incurred on your case

  • If the trial is listed for a whole day, the fee will be £750 plus vat and disbursements as explained above

Please note that all fees quoted are for representation before Plymouth Magistrates' Court. Other courts that require travel will attract additional disbursements and potentially an increased fee to reflect travel time.
